GENERAL INFORMATION ON EV SPOTS PERSONAL DATA PROTECTION POLICIES

1. WHO ARE WE?

S.C. EV SPOTS Drive S.A. is a national network of charging stations for electric cars.

We are part of one of the largest providers of electrical and renewable energy solutions and equipment in Romania: Volta Grup. We have 100% local capital and over 15 years of experience in the field.

We would like to inform you that the protection of your personal data is a constant concern for us. We will continue to inform you of several important aspects in this regard.

2. THE CATEGORIES OF DATA WE PROCESS, THE PURPOSES AND GROUNDS OF THE PROCESSING

CONCLUSION AND/OR EXECUTION OF CONTRACTS WITH EV SPOTS’ POTENTIAL AND/OR EXISTING BUSINESS PARTNERS:

· We will process your personal data for the purpose of concluding and/or executing the contract, communicating with you during the negotiation and performance of the contract, and maintaining the contractual relationship with you.

· The grounds for processing personal data are represented by: the conclusion and/or execution of the contract with you; your consent.

· In these situations, the personal data that we may process are: name and surname, telephone number, e-mail address, home and/or residence and/or correspondence address, series and number of the identity document, personal identification number, signature. Where applicable, these data may be processed in relation to your collaborators, your representatives and/or your collaborators, your contact persons and/or your collaborators and/or your employees and/or your collaborators.

ORGANIZATION AND RUNNING OF CAMPAIGNS (WITH OR WITHOUT PRIZES):

· In these situations, the personal data we process are those requested and/or provided by public authorities and institutions, as well as any other data necessary to fulfill a legal obligation.

DEFENDING OUR RIGHTS AND INTERESTS AND/OR ANY EV SPOTS AFFILIATES:

· We will process your personal data in order to defend our rights and interests (as well as those of any person affiliated with EV SPOTS) before courts of law, bailiffs, notaries public, other public authorities or institutions, arbitration tribunals, mediators and/or other public or private bodies that resolve disputes, our lawyers, consultants or other natural or legal persons, public or private, who are involved in the negotiations and/or disputes in question.

DATA PROCESSING FOR INDIVIDUALLY DETERMINED PURPOSES:

4. INEXISTENȚA UNEI OBLIGAȚII DE A NE FURNIZA DATELE DUMNEAVOASTRĂ CU CARACTER PERSONAL

· You may choose not to provide us with certain types of personal data. If you choose to do so, this may make it impossible to conclude and/or execute certain contracts with you. It may also affect our ability to provide you with the services you have requested. But also to respond to your questions/complaints/requests. Or to send you certain communications and your ability to use certain applications and/or services or their functionalities and features. However, your choice not to provide such data will not have legal consequences for you, in most cases.

5. PERSONAL DATA RETENTION PERIOD

· The retention period for your personal data varies depending on the purposes for which we process it and the category of data.

· In all cases, we will store personal data in accordance with applicable legal provisions, applicable statutes of limitations and/or recommended data protection practices.

6. DISCLOSURE OF PERSONAL DATA

· As a rule, we will not disclose your personal data. However, in certain cases, there is a possibility that we may have to disclose certain data concerning you.

· In order to fulfill the processing purposes, we may disclose your data to Volta companies, to EV SPOTS contractual partners, or to other authorized persons who process your data for EV SPOTS. We may also disclose your data to central and/or local public authorities, or to other natural and/or legal persons when there is a related obligation in this regard or our legitimate interest (for example, in order to obtain financing and fulfill our obligations).

· In order to fulfill individually determined purposes, we may disclose your data to third parties and/or persons indicated in the document you complete when granting your consent.

· In all these cases, we will make reasonable efforts to ensure that the recipients of the data process them in conditions of security and confidentiality. And that the data is processed in accordance with the purpose for which it was transmitted to them. But also with respect for your rights and interests.

7. DATA TRANSFER TO THIRD COUNTRIES OR INTERNATIONAL ORGANIZATIONS

· We do not transfer and do not intend to transfer your data to companies, organizations or individuals in third countries or to international organizations.

· If it becomes necessary to transfer your data to any of the recipients mentioned above, we will inform you in advance about this.

8. THE LACK OF AN AUTOMATED DECISION-MAKING PROCESS

· EV SPOTS does not adopt decisions based solely on automated processing of data concerning you that produce legal effects concerning you or significantly affect you.

9. YOUR RIGHTS

(a) RIGHT OF ACCESS means that you have the right to obtain confirmation from us as to whether or not we are processing personal data concerning you. Where we are processing your data, you have the right to access that data. As well as any other information relating to the manner in which it is processed.

(b) THE RIGHT TO RECTIFICATION allows you to obtain the rectification of your data that we process, if this data is inaccurate.

(c) THE RIGHT TO DATA PORTABILITY refers to your right to receive the personal data concerning you in a structured, commonly used and machine-readable format, as well as your right to obtain the transfer of such data to another personal data controller.

(d) THE RIGHT TO OBJECT is your right to object to the processing of your data, except where the processing is necessary for the fulfilment of a legal purpose.

(e) THE RIGHT TO RESTRICTION allows you to obtain restriction in certain cases of the processing of data concerning you.

(f) THE RIGHT TO DELETION OF DATA (“THE RIGHT TO BE FORGOTTEN”) means that you have the right to request the deletion of data concerning you in certain cases. For example: the data is no longer necessary for the purposes for which it was collected and processed. You withdraw your consent and there is no other legal basis for the processing. Or you object to the processing and there are no overriding legitimate reasons. Or the personal data have been processed unlawfully. Or the personal data must be deleted for compliance with a legal obligation, etc.).

(g) RIGHT TO WITHDRAW CONSENT means that you have the right to withdraw your consent at any time where the processing activity is based on your consent. However, the revocation of your consent will not affect the lawfulness of any processing based on your consent before its withdrawal.

(h) RIGHT TO LODG A COMPLAINT WITH THE COMPETENT SUPERVISORY AUTHORITY refers to your right to lodge a complaint with the supervisory authority for the processing of personal data ( www.dataprotection.ro ) regarding the processing of your data by us or on our behalf.
